By submitting a bid, the bidder acknowledges that the bidder has had the opportunity to inspect the vehicle/property or has 1 voluntarily chosen not to do so, and accepts all risks associated with purchasing the vehicle/property without further inspection.

For vehicles, the buyer is solely responsible for all title transfer requirements, registration, licensing, taxes, fees, insurance, towing, transportation, inspections, emissions testing, repairs, and legal compliance after purchase. The Village does not warrant that the vehicle can be legally operated on public roads, will pass emissions testing, will pass any safety inspection, or can be registered or titled in any particular jurisdiction. Any required odometer disclosure will be completed on the applicable title or transfer document, and the official transfer documents shall control over any mileage statement in this listing.

License plates, registration cards, Village markings, decals, radios, emergency equipment, specialized equipment, fuel cards, keys, manuals, accessories, tools, attachments, batteries, chargers, software, and other items are not included unless specifically stated in writing by the Village. The Village may remove municipal markings, equipment, technology, records, or accessories before release of the vehicle/property.

The successful bidder is responsible for all costs and arrangements necessary to remove the vehicle/ property from Village premises by the stated deadline. The buyer must provide appropriate transportation, towing, loading equipment, labor, insurance, permits, and documentation. Village personnel are not required to assist with loading, towing, repair, jump-starting, tire inflation, fluid replacement, or other removal-related work. Any assistance voluntarily provided is provided solely as a courtesy and at the buyer’s sole risk.

No vehicle/property will be released until full payment has been received and cleared, all required documents have been completed, and all auction terms have been satisfied. Failure to pay for or remove the vehicle/property by the required deadline may result in cancellation of the sale, forfeiture of any deposit or payment to the extent permitted by law, storage charges, resale or disposal of the vehicle/property, and/ or restriction from future Village auctions.

All sales are final. No refunds, returns, exchanges, repairs, credits, price adjustments, rescissions, or post sale negotiations will be provided because of condition, defects, inspection results, inability to register or insure, emissions failure, transportation issues, buyer’s mistake, failure to inspect, or buyer’s dissatisfaction.

By bidding, the bidder agrees to assume all risks associated with the vehicle/property and agrees to release, defend, indemnify, and hold harmless the Village of Bartlett, its elected and appointed officials, officers, employees, agents, representatives, attorneys, insurers, successors, and assigns from any and all claims, demands, damages, injuries, losses, liabilities, fines, costs, expenses, attorney’s fees, or causes of action arising out of or related to the bidding, purchase, payment, removal, loading, transportation, possession, repair, registration, resale, disposal, operation, or use of the vehicle/property.

Nothing in this listing shall be construed as a waiver of any right, defense, limitation, protection, or immunity available to the Village of Bartlett or its officials, officers, employees, or agents under applicable law.
